Terms and Conditions

We offer jet ski rentals, paddle board rentals, and guided boat tours on the waters of Clearwater Beach, Florida. Availability of specific equipment, tours, and add-ons may vary and is confirmed at the time of booking.

Renters and riders must meet the minimum age and any boating safety education requirements established by Florida law for the equipment being operated. A valid government-issued photo ID is required at check-in. Minors may be required to be accompanied by a parent or legal guardian who assumes responsibility for the minor at all times.

Operators must not be under the influence of alcohol or drugs at any time before or during a rental. We reserve the right to refuse or cancel service, without refund, to anyone who appears impaired, underage, or otherwise unfit to safely operate the equipment.

Reservations can be made online through this website, or by phone or WhatsApp (see Contact Us below). When you book online, you choose your experience, date, and time, and pay a 25% deposit through Stripe, our third-party payment processor, to confirm your reservation; use of Stripe's checkout is also subject to Stripe's own terms of service and privacy policy. The remaining balance is due on-site before your rental or tour begins, payable using the methods we accept at that time. If you book by phone or WhatsApp instead, the applicable deposit amount and payment method will be communicated to you directly by our team.

If you do not show up for your reservation, your deposit is not refunded. See Section 4 (Cancellations and Refunds) below for additional detail.

Cancellation and refund terms for changes you request (including any notice periods or fees) will be communicated to you at the time of booking and may vary based on weather, water, and safety conditions.

If you do not show up for your scheduled reservation, your deposit is not refunded. This no-show policy is separate from, and is not limited by, the cancellations we initiate as described below.

We reserve the right to cancel, shorten, or reschedule any rental or tour, without penalty to us, due to unsafe weather, water conditions, mechanical issues, or other circumstances beyond our reasonable control. When we cancel, shorten, or reschedule for these reasons, we will work with you in good faith on rescheduling or a refund.

By participating in our Services, you confirm that you are in adequate physical condition to safely operate a personal watercraft or paddle board, or to participate in a boat tour, and that you have no medical or physical condition that the activity could aggravate, including but not limited to pregnancy, heart conditions, back or neck problems, recent surgery, or seizure disorders.

You must disclose to our staff, before any activity begins, any condition that could affect your ability to participate safely. We may, at our discretion, refuse to allow you or any member of your party to participate on safety grounds, without refund, if we reasonably believe the activity would pose an unsafe risk to that person's health.

Operating a jet ski, paddle board, or riding on a boat involves inherent risks, including but not limited to: collision with other vessels, objects, or people; capsizing or falling overboard; drowning; equipment malfunction; adverse weather or water conditions; and the negligence of other operators. These risks exist even when equipment is properly maintained and safety instructions are followed.

By participating in our Services, you voluntarily and knowingly assume all such risks, whether known or unknown, and acknowledge that these activities can result in property damage, personal injury, or death to yourself or others.

To the fullest extent permitted by Florida law, you release, waive, discharge, and covenant not to sue Florida Fun Watersports LLC, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of ordinary negligence in connection with your participation in our Services. This release does not apply to damages caused by our gross negligence, willful misconduct, or as otherwise prohibited by applicable law.

A separate, more detailed written waiver and release of liability, assumption of risk, and indemnification agreement will be provided for physical signature (or approved electronic signature) before any rental or tour begins, as described in Section 8 (On-Site Rental Agreement and Safety Briefing Control) below. In the event of any conflict, the signed waiver document controls.

Before participating in any rental or tour, you must complete our safety briefing and sign our on-site rental agreement and liability release. These documents are presented to you in person, at our location, before your activity begins.

The signed on-site rental agreement and liability release is the controlling agreement between you and us for your rental or tour. These website Terms do not replace, and are not a substitute for, that signed document; to the extent of any conflict between these Terms and the signed on-site agreement, the signed on-site agreement controls.

If you refuse to sign the on-site rental agreement and liability release, or refuse to attend or complete the safety briefing, you will not be permitted to participate in the Services, and your deposit will be forfeited.

While using our equipment or participating in a tour, you agree to:

• Wear a properly fitted U.S. Coast Guard-approved life jacket at all times while on the water, as provided.
• Complete the safety briefing and follow all instructions given by our staff or tour guides.
• Operate equipment at a safe speed and distance from other vessels, swimmers, wildlife, and marked areas.
• Comply with all applicable Florida boating laws and regulations.
• Not operate equipment while under the influence of alcohol or drugs.
• Return equipment at the agreed time and in the condition it was provided, ordinary wear excepted.

You are responsible for the equipment rented to you from the time of pickup until it is returned to us. You agree to reimburse us for any loss, theft, or damage to the equipment that occurs during your rental period beyond ordinary wear and tear, in an amount to be reasonably determined based on repair or replacement cost.

Depending on the extent of the damage, equipment damage charges typically range from $200 to $500. In the case of total loss, theft, or damage exceeding this range, you remain responsible for the full reasonable cost of repair or replacement as described above.

To the maximum extent permitted by law, Florida Fun Watersports LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our Services or this website, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Florida or federal law.

You agree to indemnify and hold harmless Florida Fun Watersports LLC and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your negligent or willful acts, or your violation of any law or the rights of a third party.

We collect limited personal information — such as your name, email address, phone number, and booking details — when you book online or contact us directly, solely to communicate with you, manage your booking, and provide the Services. This information is stored using Supabase, our database provider, and your booking confirmation email is sent through Resend, our email delivery provider.

When you pay a deposit online, your payment is processed by Stripe, our third-party payment processor. Stripe handles and stores your card details directly; we do not see, receive, or store your full card number or other card details. Your use of Stripe's checkout is also subject to Stripe's own terms of service and privacy policy.

We do not sell your personal information to third parties. Supabase, Resend, and Stripe each process personal information on our behalf as service providers and are subject to their own respective privacy policies and security practices.

All content on this website, including text, images, and logos, is the property of Florida Fun Watersports LLC or its licensors and may not be copied, reproduced, or used without our prior written consent.

Some photographs, videos, and other imagery on this website are illustrative or digitally generated, and are used to help convey the general look and feel of our Services. These images do not necessarily depict our actual equipment, staff, rental location, water or weather conditions, or the specific experience or outcome you will receive.

The make, model, color, and condition of equipment shown on this website may differ from the equipment actually available at the time of your rental, and availability of any specific equipment is not guaranteed. Nothing shown in the photographs, videos, or other imagery on this website forms part of your contract with us or is a representation or warranty about the Services you will receive.

We may photograph or record you and other participants during your rental or tour, and may use those photographs, videos, or recordings in our marketing and promotional materials, including on our website, social media, and other advertising, without additional compensation to you.

If you do not want to be photographed or recorded, or want to withdraw your consent to a prior use, tell a staff member in writing — for example, by emailing us at funrentalfl@gmail.com — before your activity begins, and we will make reasonable efforts to honor your request going forward.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of these Terms or our Services shall be subject to the exclusive jurisdiction of the state or federal courts located in Florida.

We are not liable for any failure or delay in providing the Services caused by events beyond our reasonable control, including but not limited to severe weather, hurricanes, tropical storms, red tide or other harmful algal blooms, government or U.S. Coast Guard closures or restrictions, power or utility failures, or the failure of a third-party supplier or service provider.

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of this website or our Services after changes are posted constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

We want this website to be usable by everyone.
